These terms are an agreement between you and Lucy Chen (“we”, “us”), who makes and runs Quantifies. They cover the Quantifies apps for iOS and Android and the website at quantifies.app (together, “Quantifies”).
By creating an account or using Quantifies, you agree to these terms and acknowledge our Privacy Policy. If you don’t agree, please don’t use Quantifies.
The short version
You must be 13 or older to use Quantifies.
You own what you post. You let us store it, show it to the people you choose, and process it, including with AI, to run Quantifies.
Quantifies has zero tolerance for objectionable content and abusive users. Report it and we act within 24 hours.
AI-made stats, estimates, and insights can be wrong, and nothing in Quantifies is medical advice.
You can delete your account at any time.
1. Who can use Quantifies
You must be at least 13 years old. If you’re under 18, or under the age of majority where you live, you may use Quantifies only with the permission of a parent or guardian who agrees to these terms on your behalf.
You can’t use Quantifies if we’ve banned you before, or if the law prohibits you from using it.
2. Your account
Give accurate information and keep your password secure. You’re responsible for what happens under your account.
One person per account. Don’t share accounts, and don’t create new ones to get around a ban.
Choose a username that doesn’t impersonate anyone or infringe anyone’s rights. We may reclaim usernames that do.
If you think someone else has access to your account, email hello@quantifies.app right away.
3. Your content
You own the posts, photos, videos, comments, and anything else you add to Quantifies (“your content”). We don’t claim ownership of it, and we don’t sell it.
So that we can run Quantifies, you give us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, and distribute your content. We use this license only to operate, secure, and improve Quantifies and to show your content to the people your privacy settings allow. It includes processing your content with AI to make tags, stats, and insights, and counting it anonymously in community stats, as the Privacy Policy describes.
The license ends when you delete the content or your account, except for copies that remain for a limited time as the Privacy Policy describes.
You’re responsible for your content. Only post what you have the right to share, and get permission before posting photos of other people or information about them.
4. Community rules
Quantifies has zero tolerance for objectionable content and abusive users. Don’t post anything, or behave in any way, that:
harasses, bullies, threatens, intimidates, or stalks anyone;
attacks people for their race, ethnicity, national origin, religion, caste, sexual orientation, sex, gender identity, disability, or serious illness;
sexually exploits or endangers children in any way (we report this to the National Center for Missing & Exploited Children);
is pornographic or sexually explicit, or shares intimate images of anyone without their consent;
depicts or promotes graphic violence, terrorism, or violent extremism;
encourages or glorifies suicide, self-harm, or eating disorders;
promotes or helps with illegal activity, including selling drugs, weapons, or other regulated goods;
shares someone else’s private information, such as their address, location, phone number, or photos, without permission;
impersonates a person or organization, or misleads people about who you are;
spams, scams, or artificially inflates likes, friend requests, or stats; or
infringes anyone’s copyright, trademark, privacy, or other rights.
How we enforce the rules
You can report any post, comment, or person from the app, and you can block or mute anyone.
We act on reports of objectionable content within 24 hours by removing the content and banning the user who posted it.
We may also remove content, or suspend or close accounts, without notice when we believe it’s necessary to protect people or Quantifies.
If you’re having thoughts of suicide or self-harm, please reach out for help now: call your local emergency number, or in the US call or text 988.
5. Using Quantifies responsibly
Don’t:
access another person’s account, or collect other users’ information, including by scraping;
reverse engineer, decompile, or try to extract the source code of the apps, except where the law allows it;
get around or interfere with security features, usage limits, or other people’s privacy settings;
use bots or automation to create accounts or content, other than Quantifies’ own post-by-text feature;
overload, disrupt, or attack our servers or networks;
resell Quantifies or use it commercially without our written permission; or
use Quantifies to break the law.
6. AI, stats, and health
Quantifies uses AI to turn your posts into tags, stats, estimates such as calories, and insights. AI makes mistakes, so check anything that matters to you.
Quantifies is a personal logging tool. It isn’t a medical device, and nothing in it is medical, health, fitness, nutrition, or mental-health advice. Don’t rely on it for decisions about your health; talk to a qualified professional. In an emergency, call your local emergency number.
7. Other services
Some features rely on services we don’t run, such as Sign in with Apple, Google, Oura, and your mobile carrier. Their own terms apply to how you use them, and we aren’t responsible for them.
Your carrier’s standard message and data rates may apply when you post by text message.
8. Paid features
Some features have usage limits or may require a paid plan. If we offer a paid plan, we’ll show you the price and what’s included before you buy.
Purchases made through the Apple App Store or Google Play are handled under their terms, including billing, cancellation, and refunds.
We may change features and limits over time. If a change significantly reduces something you’ve already paid for, we’ll tell you in advance.
9. Quantifies itself
Quantifies, including its apps, design, logo, and name, belongs to us. Apart from your content, we keep all rights in it.
We give you a personal, non-exclusive, non-transferable, revocable license to use the Quantifies apps on devices you own or control, for your own non-commercial use, under these terms.
If you send us ideas or feedback, we may use them without any obligation to you.
10. Copyright complaints
If you believe something on Quantifies infringes your copyright, email hello@quantifies.app with:
the work you believe is being infringed;
the content you believe infringes it, and where it appears on Quantifies;
your name and contact details;
a statement that you believe in good faith the use isn’t authorized by the owner, its agent, or the law; and
a statement, under penalty of perjury, that your notice is accurate and that you own the copyright or are authorized to act for the owner, with your physical or electronic signature.
We remove infringing content and close the accounts of repeat infringers.
11. Ending your use
You can stop using Quantifies at any time, and delete your account in Settings.
We may suspend or close your account if you break these terms, if the law requires it, or if continuing would create risk for other people or for us.
If we ever shut Quantifies down, we’ll give you reasonable notice first whenever we can.
Sections of these terms that are meant to last, such as the disclaimers, the limitation of liability, and the section on disputes, continue to apply after your account ends.
12. Changes to these terms
If we change these terms, we’ll post the new version here and update the effective date, and we’ll tell you in the app or by email before significant changes take effect. If you keep using Quantifies after changes take effect, you accept the new terms. If you don’t agree, stop using Quantifies and delete your account.
13. Disclaimers
Quantifies is provided “as is” and “as available”. To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t promise that Quantifies will be uninterrupted, error-free, or secure, that data will never be lost, or that AI-made tags, stats, estimates, or insights will be accurate. We aren’t responsible for content other people post.
14. Limitation of liability
To the fullest extent the law allows, we won’t be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising from or relating to Quantifies or these terms. Our total liability for all claims relating to Quantifies is limited to the greater of what you paid us in the 12 months before the claim or US$50.
If you break these terms or the law, or your content infringes someone’s rights, and that leads to a claim against us, you agree to cover the reasonable costs and losses that result, to the extent the law allows.
Some places don’t allow these exclusions or limits, so they may not all apply to you. Nothing in these terms limits liability that can’t be limited by law.
15. Governing law and disputes
These terms are governed by the laws of the State of California, USA, without regard to its conflict-of-law rules. Disputes will be decided in the state or federal courts located in California, and you and we consent to their jurisdiction. If you’re a consumer and the law where you live gives you the right to bring a claim in your local courts or under your local law, these terms don’t take that right away.
If you have a problem with Quantifies, please email us first. Most things can be sorted out that way.
16. Apple App Store
If you downloaded Quantifies from Apple’s App Store, these additional terms apply:
These terms are between you and us, not Apple. Apple isn’t responsible for Quantifies or its content.
Your license to use the app is limited to Apple-branded devices you own or control, as permitted by the App Store’s Usage Rules.
Apple has no obligation to provide maintenance or support for the app.
If the app fails to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. To the fullest extent the law allows, Apple has no other warranty obligation for the app.
We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy, or similar laws.
We, not Apple, are responsible for investigating, defending, settling, and discharging any claim that the app or your use of it infringes someone else’s intellectual property rights.
You confirm that you aren’t located in a country subject to a US government embargo or designated by the US government as supporting terrorism, and that you aren’t on any US government list of prohibited or restricted parties.
You must follow any third-party terms that apply when you use the app, such as your wireless carrier’s.
Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, may enforce them against you.
17. General
These terms and the Privacy Policy are the entire agreement between you and us about Quantifies.
If any part of these terms turns out to be unenforceable, the rest stays in effect.
If we don’t enforce part of these terms right away, we haven’t given up the right to enforce it later.
You can’t transfer your rights under these terms without our consent. We may transfer ours if Quantifies is transferred to a new owner.
These terms don’t create a partnership, employment, or agency relationship between you and us.
